General Outline of a Dissolution

Getting a Divorce in California

Emotions tend to run high during the Dissolution of a Marriage, or “Divorce,” process which can impede your ability to make clear decisions. Retaining and seeking counsel is essential to ensure you are being properly guided and informed through this process. The proceedings of a divorce can be rather quick or highly complex depending on the parties involved.

Additional Considerations

Issues such as child custody, child support, spousal support, property division, and attorney’s fees may need to be resolved during the dissolution process. These matters can be addressed through agreements between the parties or requests for court orders.

Exchange of Disclosures

In California, a divorce cannot be finalized without a full and honest exchange of financial information. This is done through a formal process called the Declaration of Disclosure. This is a mandatory requirement, and our California law firm will ensure it is completed accurately to protect your interests.

Service of Documents and Response

The petitioner must have a non-party member to the case properly serve the Opposing Party or “Respondent,” with the filed documentation. The respondent must respond within 30 days of being served or the petitioner may proceed by default.

Initiating Documents

The dissolution process is initiated by the filing of a petition for dissolution. The documents must include specific details such as the date of marriage, date of separation, duration of the marriage, number and details of any children, and other relevant information. The party who filed the petition is known as the “Petitioner.”
